Terms of Service

These Terms govern your use of App (the “Service”), operated by ClickNurture. By creating an account or otherwise using the Service, you agree to these Terms.

Eligibility & account

You must be at least 18 years old and authorized to bind the business you represent. You are responsible for keeping your credentials confidential and for all activity in your workspace, including the actions of workspace members you invite.

Acceptable use

• You will comply with Meta’s WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, Facebook Platform Terms, and the Instagram Platform Policy.
• You will only message contacts who have provided prior opt-in to receive messages from your business on the relevant channel, and you will honor opt-out requests promptly.
• No spam, deceptive content, prohibited industries (as defined by Meta), harassment, adult content, or illegal use.
• Automated messages generated by AI bots must clearly identify as such when directly asked by the End User.
• You are solely responsible for the content of message templates you submit for Meta approval and for broadcast content you send.

Connected Meta channels

The Service connects to your WhatsApp Business Account via Meta’s Embedded Signup and to your Facebook Pages / Instagram Professional Accounts via Facebook Login for Business. You remain the controller of these accounts. Meta’s fees for WhatsApp conversations and any other Meta charges are governed directly by your agreement with Meta and are not collected by us.

Customer data & AI

You retain all rights to content you upload (contacts, message templates, knowledge-base documents, media). You grant us a limited license to process that content solely to provide the Service. AI-generated replies use the AI provider you configure; you are responsible for reviewing bot responses before enabling them on live channels.

Fees

App is currently offered without a platform fee during our onboarding period. We may introduce paid plans in the future with at least 30 days’ advance notice. Meta’s WhatsApp conversation charges are billed by Meta separately.

Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance may occur. We are not liable for Meta platform outages, rate limits, or policy actions that affect message delivery.

Termination

Either party may terminate at any time. You may delete your workspace from Settings; we may suspend or terminate your account for material breach of these Terms or Meta policy. On termination we revoke webhook subscriptions and delete Customer data per our retention policy.

Disclaimer & liability

The Service is provided “as is” without warranties. To the maximum extent permitted by law, our aggregate liability is limited to the fees paid to us in the preceding 12 months (or USD 100 if no fees were paid).

Changes

We may update these Terms. Material changes will be communicated in-app or by email at least 14 days before they take effect.
